The Real Cost of Separation

My name’s Bruce Provan, I’m the Managing Director of Page Provan, Family and Fertility Lawyers. I want to talk to you today about the cost of separation and in particular, the legal costs associated with doing so. When you consult with a lawyer, they will outline the options available to you.

Now, most matters won’t cost a lot of money to resolve. The vast majority of matters are resolved through negotiations, you do hear of cases where it costs people hundreds of thousands of dollars in legal fees to take a matter to court. There are those cases, but fortunately, they’re few and far between.

For most people, their matters are resolved through negotiation, and when you consult with a lawyer, they’ll explain the options available to you to resolve the matter out of court, and this includes negotiation, mediation, collaboration, and arbitration. If you have a parenting dispute, before the matter can go to court, you’re required to go through mediation or what they call family dispute resolution.

If your case can’t be resolved out of court in relation to a property matter, and one party makes an application to court, then the court will refer the matter to a mediation.

Now, the statistics show that the matters that go to mediation, most of them will resolve either at or shortly after a mediation. But there are other options available to you which your lawyer can explain, such as arbitration.

A good lawyer will be able to explain to you from the outset, not only the options but what each of the options are likely to cost you. Of course, the actual cost is going to depend on a lot of variables, the most significant being the attitude of the other parties and whether they want to resolve the matter or not.
