Good morning. My name is Bruce Provan. I’m the Managing Director of Page Provan Family and Fertility Lawyers. We’re a firm of lawyers in central Brisbane that specialise in family and fertility law. I want to talk to you today about how to choose the right family lawyer. There’s thousands of lawyers out there who practise in family law, but it’s important to find the right family lawyer for you because if you get it wrong, it can become a costly and stressful exercise.

So my first tip is to talk to family and friends. If they’ve had a good experience with a family lawyer and recommend them, chances are that you will get along and have a good relationship with your lawyer as well. But it’s not a bad idea to ask around and get a few different names, and maybe even talk to a few different lawyers before you choose the one that’s right for you. Second thing is to find the right fit of lawyer. If you want an aggressive lawyer, try and find one of those. But for most people, they don’t want an aggressive lawyer. They want a lawyer that will try and resolve their case in a manner that will give them a fair outcome without spending too much money on legal fees. So, find the right family lawyer for you.

The other things to watch out for are, to look for a family lawyer, one who specialises in family law. There are a lot of lawyers out there who dabble in a few areas of law. The difficulty is that family law is such a complex area of law, and it’s constantly changing. So, if you engage a lawyer that doesn’t specialise in family law, there’s a good chance that they may not be across the law and be the best person to help you with your case.

The next thing is to look for a lawyer who has some specialist accreditation. Each state has a specialist accreditation programme, which lawyers can undertake further study and further exams to qualify as an accredited specialist in family law. So have a look out for an accredited specialist.

The other thing to do is to look for lawyers who subspecialise. To give you an example, my partner, Stephen Page subspecialises in fertility law. He’s one of only a few lawyers in Australia that practise in that area of law, so he’s the expert in that area. You might go to another family lawyer who’s never touched fertility law, and that can become an expensive process.

Lawyers to avoid. My recommendation is that you avoid lawyers who do legal aid work or who advertise themselves as being legal aid preferred suppliers. The reason for that is that’s poorly paid work, generally done by very inexperienced lawyers. And because it’s poorly paid work, often what happens is that they’re devoting so much of their time and energy into that sort of work and don’t leave enough time to deal with you and your case.

So, there’s a few tips for finding the right family lawyer, and good luck.

3 Countries You Should Never Use for Surrogacy

When intended parents consider international surrogacy, the legal and ethical landscape can be treacherous. One government has taken a blunt but pragmatic approach: rather than issuing a blanket prohibition on overseas commercial surrogacy, it has published a short list of specific countries where surrogacy arrangements will almost certainly jeopardise a child’s legal status. That list… Read More »3 Countries You Should Never Use for Surrogacy
