Meta’s Surrogacy Policy Dilemma: Lessons from Facebook’s Review

A few years ago, Sarah Wynn-Williams interviewed me, as Facebook was looking at what position it should take about commercial #surrogacy. Facebook was concerned about the possibility of exploitation. Two great difficulties I pointed out were:

  1. What is commercial #surrogacy? There was no clear definition, and many shades of grey, making it difficult to characterise what is or is not commercial #surorgacy, in many cases.
  2. Even where it is clear that there was commercial #surrogacy, the way it is practised and regulated can vary enormously, from places where there is a clear human rights framework, and clear protections to none at all.

It is no surprise, faced with such complexity, that Facebook did not lay down a hard and fast rule about commercial #surrogacy.
